Terms and Conditions

1. Purpose

These Terms and Conditions govern access to and use of the website mihistoria.app (hereinafter, "the Site") and registration on the waiting list for the closed beta of Mi Historia: Sueños de Élite (hereinafter, "the Project"), a life simulation video game currently in development.

Accessing the Site implies express and unreserved acceptance of these Terms. If you don't agree with any of their points, you should refrain from using the Site.

2. Service operator

The Site is published under the brand Mi Historia, a project operated by a natural person on a non-profit basis during the Project's development phase.

3. Service offered

In its current phase, the Site is an informational website dedicated to presenting the Project and allowing interested people to sign up to a waiting list for early access to the closed beta when available.

The Site does not offer:

• E-commerce
• Paid subscriptions
• Financial services
• Marketplace or intermediation features

Registration on the waiting list is free and does not imply any contractual obligation on the part of the user or the operator.

4. "Mi Historia: Sueños de Élite" mobile application

Once the application is available for download on Google Play Store, the following terms apply in addition to those of the Site.

4.1. Licence to use

The operator grants the user a personal, non-exclusive, non-transferable and revocable licence to download, install and use the application on Android devices they control, exclusively for personal, non-commercial entertainment.

The user undertakes to:

• Not reverse engineer, decompile, disassemble or attempt to access the source code of the application.
• Not modify, translate, create derivative works or redistribute the application or any part of it.
• Not use bots, scripts or automation to interact with the application.
• Not attempt to bypass the monetisation systems (subscription, ads) by modifying game files, third-party patches or any other means.

4.2. Premium subscription

The application offers an optional Premium subscription at the price published in Google Play Store (currently €1.99 per month, subject to change). The subscription removes ads and may include additional benefits announced within the app.

Automatic renewal: the subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period.

Cancellation: you can cancel the subscription at any time from Google Play Store (Settings → Subscriptions → Mi Historia → Cancel). Cancellation takes effect at the end of the paid billing period; you keep access until then.

Price changes: any price increase will be notified through the application or Google Play and will require your express confirmation before being applied at the next renewal.

4.3. Refunds

Refunds are managed exclusively through Google Play according to its current policy (support.google.com/googleplay/answer/2479637). The Project operator does not process refunds directly.

If your refund request is denied by Google Play and you believe you are entitled to one under applicable European consumer law, you can write to legal@mihistoria.app so we can review your case.

4.4. Advertising

The application displays advertising to users not subscribed to Premium, served by Google AdMob. The user acknowledges and accepts:

• That ads will be shown in a bottom banner and, optionally, as rewarded videos the user chooses to watch in exchange for in-game bonuses.
• That ad content comes from third parties and is not controlled by the Project operator. If you encounter an inappropriate ad, you can report it from the ad itself or write to legal@mihistoria.app.

4.5. Save data

All save game progress is stored on the user's device. There is no synchronisation with Project servers.

The operator is not liable for the loss of saved games due to external causes (accidental uninstall, factory reset, loss or damage to the device, etc.). Users are encouraged to make their own Android device backups.

4.6. Availability

The application is offered "as is". The operator makes reasonable efforts to keep it functional and bug-free, but does not guarantee that the application will always be available, error-free, or compatible with every Android device on the market.

5. Minimum age

Use of the Site and registration on the waiting list are reserved for people 16 or older. By registering you declare you are at least 16 years old.

The operator is not responsible for false registrations that violate this restriction and reserves the right to delete any record reasonably suspected of having been submitted by a person under 16.

6. Communications

By signing up to the waiting list and accepting the GDPR consent, you authorize the operator to send you email communications related to the Project's development (devlogs, milestone notices, beta opening).

You can unsubscribe at any time through the unsubscribe link included in every email or by writing to legal@mihistoria.app. Your request will be processed within a maximum of 30 days.

7. Use restrictions

The user agrees to:

• Not use the Site for commercial purposes without express written authorization from the operator.
• Not perform automated scraping, mass data extraction or use bots, except with explicit authorization.
• Not enter false, offensive or third-party-rights-infringing information in the registration form.
• Not attempt to compromise the Site's security, access unauthorized resources or interfere with its operation.

Failure to comply with these restrictions may result in deletion of the registration and, where appropriate, in corresponding legal action.

8. Intellectual property

All Site content (texts, images, mockups, code, Mi Historia: Sueños de Élite brand) is property of the operator or used under license. Total or partial reproduction without express written authorization is prohibited.

References to third-party registered trademarks (LaLiga, Liga F, sports clubs, etc.) are made solely for descriptive purposes and do not imply any commercial relationship, sponsorship or affiliation between those entities and the Project.

9. Limitation of liability

The Site is offered "as is", in its current state. The operator does not guarantee:

• Uninterrupted Site availability (there may be outages due to maintenance or technical reasons beyond its control).
• Total absence of errors, inaccuracies or outdated content.
• That the Project will be completed or published on any specific date. Participation on the waiting list does not create a contractual obligation to deliver the final product.

To the maximum extent permitted by applicable law, the operator shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the Site.

10. Third-party services

The Site uses third-party services to operate (Brevo for email management, Cloudflare for hosting and CDN, Google Fonts for typography). The operator is not responsible for the content, availability or policies of those external services.

11. Modifications

The operator reserves the right to modify these Terms at any time. Modifications will take effect from their publication on this page. Periodic review of this section is recommended.

In case of substantial modifications affecting your rights as a registered user, you will receive an email notice.

12. Applicable law and jurisdiction

These Terms are governed by Spanish law. For any dispute arising from use of the Site or the waiting list, the parties submit to the courts and tribunals of the operator's domicile in Bizkaia, Spain, unless applicable consumer-protection law mandates a different jurisdiction in favor of the consumer.
